The Global Alliance and Treaty Organization (GATO) is an ancient community originating from another world called Cyber Nations.
Charter of the Global Alliance and Treaty Organization[]
Preamble[]
We, the members of the Global Alliance and Treaty Organization, hereby create this document to ensure the protection of the rights and freedoms of the sovereign nations of our Organization, a formal Brown Team alliance that embraces and supports world peace. We join together in the spirit of friendship in order to provide for common defense, promote general welfare, and sustain the bonds of justice which unite us all.
Article I: Membership and General Assembly[]
Section I: Membership[]
Application to the Global Alliance and Treaty Organization shall be determined by the Assembly Chairperson or appointed cabinet official. The Assembly Chairperson or appointed cabinet official may reject any application prior to approval. Upon approval of an application, the applicant begins a thirty (30) day probationary status, during which the Assembly Chairperson or appointed cabinet official may veto the applicant's approval and remove the applicant's membership status. During the thirty (30) day probationary status the approved applicant is provided with all protections and provisions offered to members of Global Alliance and Treaty Organization. Membership in the Global Alliance and Treaty Organization is exclusive, and all members are members of the General Assembly. All members are bound by this Charter and Laws of the Global Alliance and Treaty Organization.
Section II: Authority[]
The General Assembly shall hold all debates publicly. The General Assembly reserves the right to vote on all Elections, Confirmation Votes, Votes of No Confidence, Charter amendments, Treaties, War & Peace Votes, Laws, and Pardons. No member shall have this right abrogated except with the authority of the Arbiter. Any member may bring an issue to the Hall of Debate for consideration. Any member may call for a vote at any time after twenty-four (24) hours of debate have been conducted. Elections shall be excluded from this provision. Votes shall be held via polls which must be open to the General Assembly for exactly twenty-four (24) hours. Votes on Charter Amendments, Laws, and Pardon Recommendations shall be held mid-month and at the end of the calendar month. Charter amendments, Votes of No Confidence and Pardons shall be passed by a two-thirds (2/3) majority of votes cast in the polls. All other votes shall be passed by a simple majority. All rights, powers, and liberties not delegated to the Government shall be
reserved for the General Assembly.
Section III: Political Affiliations[]
Political parties, organized or disorganized, undermine the unity of which our alliance was founded. No member of the General Assembly may create or participate in any political party of any kind. All General Assembly members are considered independent of one another and while opinions may align, members may not organize strategically to politically out maneuver other members. Doing so would limit the voting power of the individuals who are not aligned with any party.
Article II: Elections[]
Section I: Terms[]
The General Assembly shall elect the Assembly Chairperson, the Arbiter and the Ombudsman. Only members of the General Assembly in good standing may hold elected positions. The Assembly Chairperson, the Arbiter and the Ombudsman will serve three (3) month terms. Elections for the Assembly Chairperson, the Arbiter and Ombudsman will be held at the end of each term.
Section II: Process[]
The electoral process shall consist of nominations, debate, and voting. Nominations will open five days prior to the end of the term and shall go for forty-eight (48) hours. Debates shall begin with nominations and continue until the end of voting. Forty-eight (48) hours prior to the end of the term, polling will begin and shall last for a period of forty-eight (48) hours. At the end of the voting period, the candidate(s) with the highest vote count in each election shall be declared the winner(s) and shall take office at the beginning of the next term. In the event of a tie vote in any election, all candidates tied shall participate in a twenty-four (24) hour runoff election. If any runoff election ends in a tie, the current Arbiter shall decide the winner.
Section III: Restrictions[]
No member may be elected to the position of Assembly Chairperson for more than four (4) consecutive terms. The Assembly Chairperson and Arbiter shall not be eligible to hold any other elected or appointed cabinet position. A member may only self-nominate or accept a nomination for one office per election.
A member is deemed to be in good standing if they’ve been in the alliance for a period of at least 90 days, have an active nation, meet or exceed the alliance’s standards in city builds and minimum military requirements, have been punctual in repayment of any loans they’ve received and have not been convicted of any crime that strips them of their right to hold office. A member's good standing shall be confirmed by the Arbiter prior to the commencement of the voting period.
An exemption to the minimum 90-day membership rule may be granted to any ex-member that left the alliance previously through a debate and vote amongst the General Assembly.
Section IV: Vacancies[]
An elected office shall be considered vacant on deletion, resignation, inactivity, vote of no confidence, expulsion, failure to log in on the forum for a period of four days without a valid reason, or seven or more consecutive days. In the event of a vacancy in any elected office other than the Assembly Chairperson, the Assembly Chairperson shall immediately appoint a successor, other than themselves, to that office. The Assembly Chairperson will name a single successor to become Assembly Chairperson if the Assembly Chairperson position is declared vacant under these articles. The successor shall take office immediately upon declared vacancy and will serve the remainder of the previous holder's term or until a failed confirmation vote. The General Assembly shall hold a confirmation vote within forty-eight (48) hours of the appointment. If the confirmation vote fails an emergency forty-eight (48) hour election will be held, twenty-four hours (24) for nominations and twenty-four (24) hours for voting, to determine the next Assembly Chairperson.
Article III. Government[]
Section I: Assembly Chairperson[]
The Assembly Chairperson is the head of state and government. They shall preside over the General Assembly, may appoint a cabinet of members to administrative roles, represent the Global Alliance and Treaty Organization domestically and abroad, and serve in the best interests of the organization as the chief government representative of the people. The Assembly Chairperson may veto any Law passed by the General Assembly within seventy-two (72) hours of its passage. The General Assembly may override a veto by a three-fourths (3/4) majority vote within seventy-two (72) hours of
its veto.
Section II: Vice Assembly Chairperson[]
The Vice Assembly Chairperson is the Assembly Chairperson's second in command. The Vice Assembly Chairperson oversees the work of all other ministries. The Vice Assembly Chairperson has designated powers that the Assembly Chairperson states and those powers cannot be more than that of the Assembly Chairperson's.
The Vice Assembly Chairperson shall step in when the Assembly Chairperson needs them too.
Section III: The Cabinet[]
The Assembly Chairperson may appoint any member in good standing to administer vital functions within the alliance. To ensure the safety, prosperity, and global image of the Global Alliance and Treaty Organization the Assembly Chairperson must appoint at least one cabinet member in charge of Defense and one cabinet member in charge of Domestic Affairs. The Assembly Chairperson reserves the right to appoint any additional cabinet members as he sees fit. The Assembly Chairperson will be responsible for outlining each cabinet member’s duties at the time of appointment. The General Assembly reserves the right to confirm each cabinet appointment with a forty-eight (48) hour vote. Confirmation is received by a simple majority. In the event of a failed confirmation the Assembly Chairperson must select a new cabinet appointee to be confirmed.
Section IV: Deputy Minister[]
Any member of the Cabinet may appoint any number of Deputy Ministers. These Deputy ministers will have the authority to do anything outlined by the Minister they are appointed by, allowing that the minister can do it themselves. A Deputy Minister is always subject to the Minister that they are appointed by, and any decision made by the Deputy Minister can be overturned by the Minister that appointed them.
Section V: Ombudsman[]
The General Assembly Ombudsman will be the General Assembly’s representative to the Government and will have access to all government areas. The Ombudsman shall oversee all government communications and decisions and will ensure that all proper procedures are followed at all times and report any infractions of alliance law to the Arbiter.
Article IV. Votes of No Confidence[]
Any member of the General Assembly may call a Vote of No Confidence on any elected or appointed official. Should a member of the General Assembly call a Vote of No Confidence, they should present all evidence of wrongdoing of the official(s) in question to start debate. A Vote of No Confidence may be called after forty-eight (48) hours of debate by the originating member of the General Assembly or by three (3) other members of the General Assembly. The Assembly Chairperson shall create a special forty-eight (48) hour polling session within twenty-four (24) hours of the member(s) of the General Assembly request for a Vote of No Confidence. If a vote succeeds the elected or appointed official shall be removed from the position for the remainder of the term. Standard Vacancy Procedures shall be followed in regard to elected positions. The Assembly Chairperson may choose to appoint a new cabinet member to replace one that was removed.
Article V: War and Peace Terms[]
Section I: Defensive War and Treaty Obligations[]
The Assembly Chairman may authorize an immediate declaration or war or recognition of hostilities on any entity that attacks the alliance. The Assembly Chairman may also authorize an immediate declaration of war or recognition of hostilities with any entity that attacks an alliance that we have a mandatory defense or protectorate treaty with.
Section II: Offensive War[]
If a request for declaration of war is made by the Assembly Chairperson, or a chosen representative, they shall present all publicly available facts to the General Assembly for a twelve (12) hour review. The General Assembly shall vote in an emergency twenty-four (24) hour poll on whether to authorize a declaration of war. The General Assembly may make restrictions on the authorization as it finds appropriate. Any military action authorized by the General Assembly expires after one week if not utilized by the Assembly Chairperson or chosen representative.
Section III: Optional Defense Treaties[]
If a request for a declaration of war is made by the Assembly Chairperson or a chosen representative to provide military assistance to an entity, we have an optional defense clause with, they shall present all publicly available facts to the General Assembly for a twelve (12) hour review. The General Assembly shall vote in an emergency twenty-four (24) hour poll on whether to authorize a declaration of war. The General Assembly may make restrictions on the authorization as it finds appropriate. Any military action authorized by the General Assembly expires after one week if not utilized by the Assembly Chairperson or chosen representative.
Section IV: Peace Terms[]
Any peace, and any terms and conditions of peace shall be presented to the General Assembly for approval via a similar twelve (12) hour debate and twenty-four (24) hour poll.
Section V: Other Military Action[]
The Assembly Chairperson or appointed cabinet member in charge of Defense may authorize military action against any non-member or non-allied nation that conducts or supports military action against any other nation. The Assembly Chairperson may order a cessation of any military action conducted under this subsection. Members may engage in military combat with any non-member, non-allied, and non-protected nation at their own risk. Any member doing so forfeits the protections of the Global Alliance and Treaty Organization. The Assembly Chairperson or the cabinet member in charge of Defense may authorize military action against member nations to fulfill lawfully-imposed court sentences, in direct response to unauthorized attacks on the Global Alliance and Treaty Organization or its allies, or to prevent the loss of assets of the Global Alliance and Treaty Organization. In the event of an attack against any member of the General Assembly, the Assembly Chairperson or cabinet member in charge of Defense shall authorize attacks to defend the member.
Article VI: Arbiter[]
Section I: Authority[]
The Arbiter shall judge all civil and criminal cases and shall consist of one individual serving in an independent, adjudicating role. The judicial power of the alliance is vested under this one Arbiter. The Arbiter will convene after a grievance and substantial evidence has been presented by one member against another. The Arbiter may reject hearing any case provided good reason. Such a rejection shall not prohibit similar charges being brought in the future against the accused. The Arbiter will hear testimony and review evidence at its discretion, and thereafter deliberate in private. The Arbiter shall determine whether the accused is guilty or not guilty. If the accused is found guilty, the Arbiter shall be the sole authority in determination of punishment which may include expulsion. If the accused is found not guilty, the member will be free to go. All Arbiter decisions and rulings must be made public.
Section II: Member Rights[]
All defendants are innocent until proven guilty. All defendants shall have the right to a speedy, public, and fair trial; and shall not be twice put in jeopardy for the same crime. All defendants shall have the right to choose individuals to represent their case at their own discretion. Sentenced members of the General Assembly have the right to an appeal. An appeal may be lodged not more than six calendar months after the original decision was handed down. An appeal can be lodged one of three grounds;
- 1) the ruling: an appeal that challenges the guilty or not guilty decision handed down by the arbiter or the punishment associated.
- 2) The evidence: an appeal may be heard if there is substantial new information relating to the evidence used to hand down a decision.
- 3) The process: a member may appeal to a decision based on the process conducted by the arbiter or prosecuting interest. The appeal process will work in concordance with the rules laid out above. a sentence handed down must take into account decisions made in similar cases. Upon receipt of an appeal the Arbiter retains the right to reject an appeal.
Section III: Removal of the Arbiter[]
If the Arbiter is put on trial for any reason, they will be temporarily relieved of their duties. If an Arbiter is removed temporarily from office, an emergency election will be held with twenty-four (24) hours of nominations and twenty-four (24) hours of voting. If the Arbiter is found guilty, they shall be removed from the office for the remainder of the term, and the temporary Arbiter shall finish the term. If the Arbiter is found not guilty, they shall return to their position, and the temporary Arbiter shall vacate the position.
Section IV: Advisories[]
The Arbiter may issue advisory opinions regarding the interpretation of this Charter, Treaties, and Laws of the alliance. Such advisory opinions shall have the same force and effect as any other decision of the Arbiter.
Article VII: Membership Suspension[]
Section I: Suspension[]
The Assembly Chairperson may suspend the membership and limit the access of any Global Alliance and Treaty Organization member if substantial evidence of the member acting in a manner that threatens the security of the alliance during peacetime or war can be presented against that member. The Assembly Chairperson must notify the Arbiter, and the Arbiter will proceed immediately to trial.
Section II: Pardons[]
If a nation has been expelled from the alliance, they cannot gain membership unless pardoned by the Assembly Chairperson. The Assembly Chairperson can only give a pardon upon recommendation of the General Assembly. The Assembly Chairperson may grant a pardon for any specific crime to any nation upon recommendation by the General Assembly. A pardon shall remove the conviction and sentence from the nation. Any crime for which a nation is expelled from the Global Alliance and Treaty Organization may not be pardoned for at least fourteen (14) days after the expulsion is ordered.
